Seven policemen were charged at the Kuala Lumpur Sessions Court today in connection with the case of a 27-year-old man and 18-year-old teenager being allegedly scalded with hot water at the Brickfields police district headquarters.The seven were charged under Section 506 and Section 304 of the Penal Code for collectively committing an act of criminal intimidation and voluntary causing hurt to extort a confession.
Those charged were Sgt Mohd Shafiee Abdul Halim, Sgt Mohd Diah Sulaiman, Sgt Zulkiplly Taib, Cpl Abdullah Musa, Cpl Zamrin Zaid, L/Cpl Matila @ Saudi Ismail dan L/Cpl Nizam Abdul Wahab from the Criminal Investigations Department (CID).
They were accused of committing the offence against B Parabakar and C Solomon between 10.15pm on Dec 23 and 3.30am on Dec 24.
The seven pleaded not guilty and posted the RM5,000 each bail. If found guilty, they face a prison term of up to seven years and a fine.
Solomon, who is missing, was picked up by police and taken to the Brickfields district police headquarters on Dec 23 to assist in the investigation of an extortion case.
Prabakar, a friend and colleague, was taken in at the same time from their place of work at Sri Hartamas.
He alleged that he failed to provide the police with any information, he was tortured in various ways by 11 policemen, including having boiling hot water poured on him.
Prabakar was released from remand on police bail on Dec 28 - the last he saw Solomon.
Memorandum to Suhakam
Kapar PKR parliamentarian S Manikavasagam today submitted another memorandum to the Human Rights Commission of Malaysia (Suhakam) on behalf of Prabakar.
Other members of Parliament who present were M Manogaran (Teluk Intan-DAP), Lim Lip Eng (Segambut-DAP) and Loh Gwo Burne (Kelana Jaya-PKR).
Suhakam Commissioner Siva Subramaniam, who received the memorandum, said that since the matter was now before the courts there were limitations to what Suhakam could do.
However, he assured that the commission’s legal division would study the memo and put up a paper for the commission to consider.
He said the key issue at hand was that police officers lacked training and Suhakam was hoping to organise more programmes with the police, especially investigation officers, on human rights.
“Police officers should keep in mind that they are not above the law. Although upon arrest they can use minimal force but during the investigation they must follow the norms,” said Subramaniam.
“These practices do not reflect well for a developed country,” he said. Prabakar, who was present, said that he was unhappy that only seven policemen were identified and prosecuted. “When I gave my statement, I said there were nine of them,” he said, adding that when he was called for an identification parade only seven policemen were in the line-up.
‘Case not an isolated matter’
Prabakar’s lawyer, N Surendran , lamented that the case was not an isolated matter and raised concerns about the attitude of the police force.
“The police seem to be routinely doing this (brutality) when arresting a suspect [...] for example, beating with a rubber hose on the soles of the feet, we know this to be a routine thing [...] I feel it is safe to say the police do it in the routine way,” he said.
“I have been practising law for 15 years and I have come across many incidents of clients who have related the same stories…and yet nothing seems to be done in order to remedy the situation.
“So it won’t be an exaggeration for us to say that many of our police lock-ups are little more than torture chambers,used by the police in order to oppress and treat suspects in the most shocking manner.”
In addition, Surendran claimed that there must be something unstable about individuals who performed such brutality.
“To actually do this to another human being, one must be in some manner sick,” he added. Surendran also asked whether “normal people joined the police force but something in the police culture corrupted them and turned them into monsters”.
Surendran said Suhakam must present a “harder stance” on the matter and pressurise the police to overcome their lackadaisical attitude. |

Belum pernah berlaku dalam sejarah kempen mana-mana pilihan raya di Terengganu, masyarakat Tionghua setempat sebegitu ramai dan berani menghadirkan diri dalam program dianjurkan parti-parti pembangkang.
Jika selama ini kaum tersebut dikatakan sangat setia terhadap Barisan Nasional (BN) dan amat berhati-hati untuk menunjukkan sikap menyebelahi pembangkang, suasana yang sama sekali berbeza kini terzahir dalam Pilihan Raya Kecil Parlimen Kuala Terengganu yang sedang berlangsung.
Bukan sekadar pendengar
Mereka bukan setakat hadir sebagai pendengar, malah ada yang turut menjadi penggerak penting menjayakan apa-apa majlis dianjurkan mana-mana parti Pakatan Rakyat bagi membantu PAS.
"Bayangkan, yang lelaki bawa bendera bulan (PAS), yang perempuan tukang pungut derma. Demi Allah, sepanjang hidup saya dah lebih 60 tahun, tak pernah lagi saya tengok benda ni," ujar seorang penduduk Kuala Terengganu, Haji Wan Mokhtar Mohamad.
Beliau menceritakan ketakjubannya melihat pasangan berbangsa Cina itu yang bertugas penuh dedikasi di satu ceramah PAS di Kampung Cina, malam hari Sabtu (10 Januari) lalu.
Dalam perkembangan serupa, lebih 300 penduduk Tionghua kelihatan hadir ke majlis ceraman PAS di Kampung Pulau Kambing, malam sebelumnya. Kesungguhan mereka menzahirkan sokongan kepada Pakatan Rakyat, khususnya PAS, dianggap perubahan sangat mendadak berbanding pilihan raya umum, Mac lalu.
"Program (ceramah) PAS semasa pilihan raya dulu di situ, orang Cina yang hadir berbelas orang saja," banding seorang rakan wartawan, Yusof Muda.
Menurut maklumat diperolehinya, kawasan berkenaan adalah di antara lokaliti yang menyaksikan kekalahan PAS agak besar, terutama di kalangan pengundi Tionghua.
Penentu kemenangan
Meski pun pengundi kaum itu membentuk hanya kira-kira 11 peratus atau tidak sampai 9,000 daripada lebih 80 ribu pemilih berdaftar di Parlimen Kuala Terengganu, sokongan masyarakat tersebut kepada mana-mana parti bertanding adalah penentu kemenangan. Apatah lagi sejak sekian lama sokongan pengundi Melayu di parlimen ini agak seimbang kepada PAS dan BN.
Mengakui undi Cina amat signifikan, BN tanpa silu memanipulasi kuasa dan kewangan dimilikinya untuk memenangi hati mereka. Menteri Besar Terengganu, Datuk Ahmad Said secara tiba-tiba mengumumkan peruntukan RM6.1 juta untuk pembangunan masyarakat Cina negeri itu, 26 Disember lalu.
Jumlah itu termasuk RM3.3 juta untuk Dewan Perhimpunan Perhubungan Cina Terengganu di Pulau Kambing dan RM2.8 juta untuk dewan Sekolah Menengah Chung Hwa Wei Sin, Gong Kapas.
Berbagai majlis lain turut dianjurkan BN saban hari melibatkan kaum Tionghua. Segala macam bantuan dihulurkan pada majlis-majlis itu atas berbagai nama, terutama yang dinamakan bantuan dana khas sempena sambutan Tahun Baru Cina. Kesemua pembesar negara yang turun berkempen juga tidak melepaskan peluang bertemu anggota masyarakat itu.
"Saya harap pengundi Tionghua di Kuala Terengganu ini tidak termakan umpan dana khas itu. Duit ang pau itu boleh diambil, sebab bukan duit peribadi pemimpin MCA-BN, tetapi itu memang duit rakyat," bidas Pengerusi Penaja DAP Cawangan Kampung Cina, Ng Chai Hing. |

மலேசிய மத்திய, வட பகுதி மாநிலங்களில் பெய்த கன மழையைத் தொடர்ந்து அங்கு பல இடங்களில் வெள்ளப்பெருக்கு ஏற்பட்டுள்ளது.வெள்ளத்தால் மோசமாகப் பாதிக்கப்பட்ட பாகாங் மாநிலத்திலும் கிளந்தானிலும் பாதுகாப்பு கருதி 5,000 பேர் வெளியேற்றப்பட்டதாக போலிசார் கூறினர்.கிளந்தானில் முக்கிய சாலைகளில் வெள்ளநீர் தேங்கி நின்றதால் அப்பகுதிகளில் வாகனங்கள் செல்ல அனுமதிக்கப்படவில்லை.அசம்பாவிதங்கள் ஏற்படுவதைத் தவிர்க்கும் நோக்கத்தில் வெள்ளப்பெருக்கால் மோசமாகப் பாதிக்கப்பட்ட பள்ளிகள் அனைத்தையும் ஒரு நாளைக்கு மூடுமாறு கிளந்தான் கல்வி இலாகா உத்தரவிட்டதாக த ஸ்டார் தகவல் கூறியது.பள்ளிக்கூடங்கள் மூடப்பட்டதால் சுமார் 30,000 மாணவர்கள் முதல் நாள் பள்ளிக்கூடத்திற்கு செல்ல முடியாமல் போனது.கிளந்தானில் இரு ஆறுகளில் நீர்மட்ட அளவு அபாய கட்டத்தை எட்டியிருப்பதாகக் கூறப்படுகிறது. திரங்கானு மாநிலத்தில் ஒரு சில இடங்களில் வெள்ளப்பெருக்கு அதிகரித்திருப்பதாக பெர்னாமா தகவல் கூறியது.Labels: incident |

| மலேசியாவில் ஆளும் கூட்டணிக் கட்சியிடமிருந்து ஆட்சியைக் கைப்பற்றுவோம்,”என்று மலேசிய எதிர்க்கட்சித் தலைவர் அன்வர் இப்ராகிம் தெரிவித்துள்ளார்.திரங்கானு மாநிலத்தில் இடைத் தேர்தல் நடைபெறவுள்ள வேளையில் அவர் மீண்டும் இவ்வாறு கூறியுள்ளார்.ஏற்கனவே அவர் இரண்டு முறை, ஆட்சியை எதிர்க்கட்சி கைப்பற்றும் என்று கூறியிருந்தார். ஆளும் கட்சி நாடாளுமன்ற உறுப்பினர்களின் ஆதரவுடன் செப்டம்பர் 16-ம் தேதிக்குள் ஆட்சியைக் கைப்பற்றப்போவதாக அவர் முன்பு அறிவித்திருந்தார்.ஆனால் அந்த காலக் கட்டத்திற்குள் அவர் கொடுத்த வாக்குறுதியை நிறைவேற்றத் தவறினார்.திரங்கானு மாநிலத்தில் வரும் 17-ம் தேதி நடைபெறவுள்ள இடைத் தேர்தலில் வெற்றி பெற முடியும் என்று எதிர்க்கட்சியும் ஆளும் தேசிய முன்னணியும் நம்பிக்கை கொண்டுள்ளன.இடைத் தேர்தலுக்கான பிரசாரம் சூடுபிடித்துள்ள வேளையில் அன்வர் நேற்று பிரசாரக் கூட்டத்தில் பேசினார் . அவரது உரையைக் கேட்க ஆதரவாளர்கள் 10,000 பேர் திரண்டிருந்ததாக ஏஎப்பி தகவல் கூறியது.கெஅடிலான், பாஸ், ஜனநாயக செயல்கட்சி ஆகிய மூன்று எதிர்க்கட்சிகள் சேர்ந்து அமைத்துள்ள கூட்டணி, ஆளும் தேசிய முன்னணியிடமிருந்து ஆட்சியைக் கைப்பற்ற உறுதி பூண்டுள்ளது என்று அன்வர் கூறினார்.திரங்கானு இடைத்தேர்தலில் பாஸ் கட்சி வேட்பாளர் வெற்றி பெற பாடுபடுவேன் என்றும் அன்வர் தெரிவித்தார்.திரங்கானுவில் மும்முனைப் போட்டி நிலவுகிறது. ஆளும் தேசிய முன்னணி உள்துறை துணை அமைச்சர் வான் அகமது பாரிட்டை களத்தில் இறக்கியுள்ளது.நடந்து முடிந்த பொதுத் தேர்தலில் பின்னடைவை சந்தித்த ஆளும் கூட்டணி இந்த இடைத் தேர்தலில் திரங்கானுவை கைப்பற்றுவோம் என்று அறிவித்துள்ளது.மலேசியப் பிரதமர் பொறுப்பை ஏற்கவிருக்கும் இப்போதைய துணைப் பிரதமர் நஜிப் துன் ரசாக்கிற்கு இந்த இடைத் தேர்தல் முக்கியம் வாய்ந்ததாகக் கருதப்படுகிறது. பாஸ் கட்சி சார்பில் 52 வயதான முகம்மது அப்துல் வாஹித் போட்டியிடுகிறார்.சுயேச்சை வேட்பாளர் ஒருவரும் இடைத் தேர்தலில் போட்டியிடுகிறார். இந்நிலையில் எதிர்க்கட்சிகள் அமைத்துள்ள மக்கள் சக்தி எனும் கூட்டணியில் உறுப்பினர்களிடையே அதிருப்தி ஏற்பட்டிருப்பதாகக் கூறப்படுவதை அன்வர் மறுத்துள்ளார். | Unauthorised diaspora meet |

The Ministry of Overseas Indian Affairs Friday warned against a diaspora meet being held under the aegis of an organisation called ‘Pravasi Bharati’ in Thiruvananthapuram in January and clarified that it was not affiliated to any government body.The organisation called Pravasi Bharati does not have any affiliation with the central government or the Ministry of Overseas Indian Affairs, the office of the Overseas Indian Affairs Minister Vayalar Ravi said here.
According to the advertisements by the organisation, the seventh annual celebrations of the ‘Pravasi Bharathi Day 2009′ would be held in Thiruvananthapuram Jan 9, 10 and 11.
The organisation has photographs of President Pratibha Patil, Prime Minister Manmohan Singh, Vayalar Ravi and Kerala Chief Minister V.S. Achuthanandan in its advertisement printed on the background of the Indian parliament and the Kerala Secretariat building to confuse people, the office said in a statement.
“The Overseas Indian Affairs Ministry is not aware of the existence of the organisation called ‘Pravasi Bharati’,” the statement said, urging people to be cautious of such advertisements.
The next edition of the Pravasi Bharatiya Divas, the annual conclave of the Indian diaspora organised under the aegis of the Ministry of Overseas Indian Affairs, is slated to be held Jan 7-9 in Chennai. |

MIC president Datuk Seri S. Samy Vellu lambasted the outlawed Hindu Rights Action Force (Hindraf) leader, P. Waythamoorthy, for distributing a pamphlet containing seditious allegations at the ongoing Pravasi Bharatiya Divas here.
“All the allegations are lies. As a lawyer, he should know that he would have to pay for it if he tells lies,” he told reporters.
Samy Vellu said the Indian Government and leaders were wise and would not listen to their call for them to stop all investments in Malaysia and also refrain from buying palm oil.
He said Waythamoorthy was behind time when he alleged that Indian slavery, including sex and child slavery was rampant in Malaysia even after 51 years of independence.
Samy Vellu, who is leading a 150-member delegation to the three-day conference, said the claim that there were 150,000 Malaysian Indians who were stateless was an outright lie.
In fact there were only 21,000 people without birth certificates and the Home Affairs Ministry had been directed to attend to the problem, he said.
Samy Vellu said they would write to the Indian government to inform them that the allegations in the pamphlet were not true.
Human Resources Minister Datuk Dr S. Subramaniam, who is also here, said he had briefed Indian Foreign Minister Pranab Mukerjee, Home Minister P. Chidambaram and Overseas Affairs Minister Vayalar Ravi last week about the situation faced by Indians in Malaysia.
“They value the good relationship between Malaysia and India and are aware of the tremendous progress of the Indian community in Malaysia,” he said.

Engaging the Diaspora:
The Way ForwardThe 7th Pravasi Bharatiya Divas (PBD) Convention is sched  uled to be held at the Chennai Trade Centre, Chennai from 07-09 January 2009. Organised by the Ministry of Overseas Indian Affairs in partnership with the State Government of Tamil Nadu and the Confederation of Indian Industry (CII), it would be the first PBD Convention organised in Chennai.PBD Conventions provide a platform for exchange of views and networking to the Persons of Indian Origin settled all over the world on matters of common interest. Such Conventions have helped the Government to better understand the expectations of the Overseas Indian Community from the land of their ancestors and acknowledge the important role played by it In India's efforts to acquire its rightful place in the comity of nations.Among the decisions taken by the Government of India as a result of wider consultations held at these Conventions, are formulation of the Overseas Citizenship of India, establishment of Overseas Indian Facilitation Centre, Conceptualisation of PIO University, formation of Prime Minister's Global Advisory Council of People of Indian Origin, and the proposed India Development Foundation. A series of Programmes e.g. Know India Programme and Scholarship Programme for Diaspora Children are also designed specifically for Diaspora youth.Among other things, the 7th PBD Convention would have sessions on the preservation of Diaspora language and culture and the importance of Diaspora as facilitators and bridge builders. The highlights of PBD 2009 include an Exhibition on Trade & Industry, live demonstrations by craftsmen, cultural evenings and post convention tours.The Convention would be inaugurated by the Prime Minister of India on 8th January. The President of India would deliver the valedictory address and also confer Pravasi Bharatiya Samman Awards for 2009 on 9th January.
